Moradabad
(Uttar Pradesh), September 17: Nine years ago, a maternal uncle of the victim
had allegedly raped her mentally weak (slow learner) niece in Bilari police
station area. The accused was convicted on Wednesday and was sentenced to 10
years rigorous imprisonment and a fine of Rupees 27 thousand by a fast track
court presided by Honourable Yogendra Chauhan.
The
father of the victim had registered a case on 13 August 2012 against the
accused in Bilari police station. The victim, then a minor, was taken by the accused
with the permission of her parents six months before the case was filed. He had
sought the victim for taking care of his wife, as she was ailing. A month later
when the victim returned, there was a noticeable change in her behaviour, she
remained silent most of the times. After around six months of her return the
girl started gaining weight and she was visibly pregnant.
Alarmed
the family questioned the rape survivor, which is when she narrated what happened
to her and how her uncle raped her at his residence. And he also threatened to kill
her if she shared anything about it to anyone.
The
police filed a case against the accused and sent the girl for medical
examination after receiving the complaint; medical reports confirmed that she
was pregnant. By this time minor had turned nineteen and the police sent the
accused to jail. The defence pleaded innocent and said he was falsely being framed
due to family enmity.
Assistant
District Government Advocate Ashok Yadav said that the victim in her statements
told that the heinous crime was committed by the culprit and the medical
reports also presented before the court confirmed the victim’s pregnancy. On
the basis this and the testimonies of the witnesses, the court convicted the
culprit of rape and sentenced him to ten year imprisonment and a fine of rupees
twenty seven thousand. Also the court has ordered to pay the victim half of the
amount of the fine as compensation.
